Facts

The Plaintiff filed an originating summons against the Defendant claiming several reliefs. The matter sought to declare the four year tenure of office of the incumbent Governor of Anambra State in accordance with Sections 180 and 185 of the Constitution of the Federal Republic of Nigeria.

Some of the reliefs were directed at the Independent Electoral Commission whom was however was not joined as a party to the suit by the Plaintiff.

When the matter came up in the Supreme Court on 3/4/07, the Court, suo motu requested the parties to address it on whether or not it has original jurisdiction to entertain the suit.
